Overview
These Terms govern the Candle Dippers website, purchases, and related services. “Candle Dippers,” “we,” and “us” refer to the seller trading as Candle Dippers identified in our Contact Information.
You agree to these Terms and the incorporated policies when you check an agreement box, place an order through a flow that clearly presents that action as acceptance, or otherwise manifest legally valid assent after reasonably conspicuous notice and an opportunity to review them. Where governing law recognizes acceptance by continued use after such notice, that use also constitutes acceptance. If you do not agree, do not use the Services or order. Please read and save the terms. Mere page access without legally sufficient notice and assent does not establish agreement, and general acceptance is not separate consent to optional marketing, tracking or recurring charges.
The Return & Refund Policy controls ordinary returns; the Shipping Policy controls shipping and transit issues; the Warranty & Product Guarantee Policy controls its covered claims; and the Purchase Options Policy controls expressly offered preorders, subscriptions and trials. The Privacy Policy describes personal information practices. Specific written product promises made at purchase remain effective. Summaries and popups explain the policies but do not remove those promises or rights that cannot lawfully be waived.
IMPORTANT: THESE TERMS INCLUDE A ONE-YEAR LIMIT FOR CERTAIN SALE-OF-GOODS CONTRACT CLAIMS, LIMITATIONS OF LIABILITY, INDIVIDUAL ARBITRATION AND A CLASS-ACTION WAIVER. A SEPARATE JURY-TRIAL WAIVER APPLIES WHERE ENFORCEABLE. READ THESE SECTIONS BEFORE ACCEPTING.
Commercial Transactions and Applicable Exceptions
If you order on behalf of a business or other organization, you represent that you have authority to bind it, and references to you include that organization. You are responsible for identifying your intended use accurately. Consumer-specific exceptions in these Terms and our policies apply only to the products, transactions, claims and jurisdictions covered by the relevant law; they are not a general extension of consumer remedies to commercial buyers. Legal classification depends on the applicable law and facts, not simply on a business name or a checkbox. Nothing limits an express product promise we actually made.
Definitions
For purposes of these Terms of Service:
- "Candle Dippers," "Company," "we," "us," and "our" mean Candle Dippers.
- "Services" means our website, storefront, checkout, pages, communications, content, tools, features, customer support, and related services we make available.
- "Products" means any goods, equipment, frames, accessories, components, kits, materials, downloads, documentation, or other items offered by us.
- "Content" means all text, images, graphics, photographs, video, audio, designs, layouts, documentation, product descriptions, compilations, trademarks, branding, and other content made available through the Services.
- "Terms" means these Terms of Service together with the policies incorporated by reference, including the Return & Refund Policy, Shipping Policy, Privacy Policy, Warranty & Product Guarantee Policy, and, where applicable, the Purchase Options Policy.
- "Customer," "you," and "your" mean any person who accesses, uses, or purchases through the Services.
- "Purchase Options" means any subscription, recurring delivery arrangement, auto-renewing order, preorder, try-before-you-buy arrangement, or other recurring or deferred purchase feature offered through the Services.
Electronic Communications and Signatures
By taking an action clearly presented as acceptance after an opportunity to review these Terms, you agree to use electronic records and signatures for the transaction to the extent permitted by law. You consent to receive order confirmations, transaction records, disclosures, policy copies and service notices electronically at your supplied contact information or through an account where legally sufficient. Electronic records satisfy writing requirements to the extent applicable law permits. Keep your contact information current and save your records.
Where law requires additional disclosures or affirmative consent for electronic delivery of particular records, those requirements still apply. This clause does not replace separate consent required for marketing, cookies or recurring billing. Contact support@candledippers.com for a copy of the terms associated with your order.
Eligibility and Accounts
You must be legally able to enter into a binding agreement to use our Services or place an order. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not assign, transfer, sell, or share your account except with our prior written consent.
You agree to provide current, complete, and accurate information in connection with your account, orders, and communications with us.
Orders, Pricing, and Acceptance
Placing an order is an offer to purchase. We accept it when we ship the product or expressly confirm acceptance. An automatic order acknowledgment is not itself acceptance. Payment authorization or capture does not remove our shipping, cancellation or refund obligations.
We may decline, limit or cancel an order for a lawful reason including unavailable stock, pricing errors, suspected payment fraud, suspected unauthorized resale, export or sanctions risk, breach of these Terms, or quantity limits. We may set reasonable limits per person, household, address, account or payment method. Prices, descriptions, promotions, availability and shipping options for future orders may change without notice, subject to applicable law. We may request reasonable verification through a secure process. Do not email a full payment-card number or identity document unless we have arranged an appropriate secure method.
The agreed price is the amount disclosed when you order, including disclosed taxes, shipping and selected extras. Later price changes do not change an existing order. If an error prevents fulfillment at that price, we will explain and offer cancellation with a prompt refund; we will not impose a higher charge without your agreement. If we cancel, we will release any payment authorization or promptly refund collected payment for the canceled items and associated unearned charges.
Prototype photos, development updates and waitlist signups are not paid preorder offers. The actual product offer must identify what is being sold and its availability or estimated shipping window. Material changes to a paid preorder require the notice and choices in the Purchase Options Policy.
Taxes
Unless otherwise expressly stated, prices shown through the Services do not include applicable sales, use, value-added, excise, customs, import, or similar taxes or charges. You are responsible for all such taxes and charges associated with your order, other than taxes imposed on our net income.
Payment and Fraud Prevention
You represent that you are authorized to use the payment method submitted and that the information you provide is accurate. We may use third-party payment processors, fraud-prevention tools, and verification services in connection with any order.
If a chargeback, reversal, or payment dispute is initiated in bad faith, or after you have retained the Product without complying with our published policies and reasonable claim procedures, we reserve the right, to the extent permitted by law, to dispute the chargeback, suspend future orders, and seek recovery of amounts due plus recoverable costs and fees. This paragraph does not limit your right to raise a good-faith dispute.
Payment disputes do not by themselves extinguish a lawful payment obligation. We may use order, acceptance, product, fulfillment and communication records to contest a chargeback and pursue amounts or goods lawfully recoverable. Refunds, reversals, returned goods and other recoveries will be credited as appropriate; this provision does not permit duplicate recovery or restrict a good-faith dispute protected by law or binding payment-network rules.
Shipping and Delivery
Our Shipping Policy forms part of these Terms and governs shipment, delivery, shipping protection, transit-related issues, title, and risk of loss, subject to applicable law.
Returns, Exchanges, and Cancellations
Our Return & Refund Policy forms part of these Terms. Additional rules for covered warranty claims and Purchase Options are addressed in the applicable incorporated policies.
If your order includes Purchase Options, the Purchase Options Policy also applies.
Product Warranties and Guarantees
Some Products may be covered by a separate written warranty or guarantee, as expressly stated on the applicable product page or in accompanying materials. Those terms control the scope, duration, exclusions, and remedies for the covered Product.
Except as expressly provided in an applicable written warranty or guarantee, Products and Services are provided subject to these Terms.
Product Use and Responsibility
You are responsible for selecting Products suitable for your intended use and for using, storing, assembling, maintaining, and handling them properly. Candle making, dipping, heating, handling wax, and related craft activities involve obvious and inherent risks, including heat, hot liquids, burns, spills, fire hazards, breakage, and damage to surrounding materials.
Product instructions, warnings, safe-use requirements, and maintenance guidance form part of the conditions of ordinary intended use. You are responsible for using appropriate care, supervision, and protective measures. We are not responsible for injury, damage, or loss caused by misuse, abuse, improper storage, improper maintenance, unauthorized modification, use with incompatible third-party materials or equipment, or use outside a Product's intended purpose.
You are responsible for training and supervising your operators, testing your process and finished candles, observing stated capacity and safety limits, and complying with laws applicable to your operation. We do not certify your finished candles or warrant your production output, profits, or suitability for an undisclosed formulation or process. Ordinary intended use includes commercial candlemaking expressly described for the Product.
Intellectual Property; Patents; No Implied License
All Content, designs, product names, graphics, branding, methods, systems, documentation, and product-related intellectual property made available by Candle Dippers are owned by Candle Dippers or its licensors and are protected by applicable intellectual property laws. Certain Products, methods, systems, or designs may be covered by one or more issued patents or pending patent applications.
No purchase, use of a Product, access to our site, or disclosure of information grants any license, immunity, waiver, or other right under any patent, patent application, trade secret, copyright, trademark, or other intellectual property right, except for the limited right to use an authentic Product you lawfully purchased from us for its ordinary intended purpose and in accordance with these Terms. Retail purchase does not authorize commercial replication, manufacturing, white-labeling, distribution, or competitive exploitation.
You may not:
- Copy, reproduce, distribute, or commercially exploit our Content or Products.
- Modify, adapt, or create derivative products or designs based on our Products, systems, or materials.
- Reverse engineer, disassemble, or otherwise attempt to derive any non-public design features, methods, dimensions, or know-how embodied in our Products or Services, except to the extent such restriction is prohibited by applicable law.
- Manufacture, source, white-label, offer for sale, sell, license, distribute, import, or export any product or system that practices, copies, derives from, or is designed to capitalize on our protected inventions, proprietary designs, or know-how.
- Remove or alter patent, copyright, trademark, warning, or source-identifying notices.
- Use our site, Products, or Content to develop or support a competing product or business.
If you are interested in legitimate commercial rights, manufacturing rights, distribution rights, or another business arrangement, contact us at licensing@candledippers.com. Any such rights are available only through a separate written agreement signed by an authorized representative of Candle Dippers.
Unauthorized use of our intellectual property is a material breach of these Terms. We reserve the right to seek injunctive relief, equitable relief, and all other remedies available at law or in equity.
These restrictions include scanning or measuring our Products to prepare commercial reproductions and providing resulting drawings, dimensions, models or manufacturing files to suppliers or others for that purpose. They are contractual restrictions in addition to our intellectual property remedies. The ordinary-intended-use permission above remains effective, including making candles for sale with authentic Products. These Terms do not restrict protected honest reviews or rights that applicable law makes non-waivable. References to pending patent applications do not represent that an application is an issued patent.
Export and Sanctions Compliance
You may not purchase, export, re-export, transfer, or use any Product in violation of any applicable trade, export-control, or sanctions law. We may refuse, cancel, or limit any order that presents export-control, sanctions, or customs-compliance concerns.
Prohibited Uses
You may not use our Services for any unlawful, fraudulent, deceptive, abusive, or malicious purpose. You may not interfere with site security, transmit malware, use automated purchasing tools without authorization, scrape data, impersonate others, or otherwise use the site in a way that could damage the site, our business, or other users.
Reviews, Submissions, and User Content
If you submit or post reviews, photos, comments, suggestions, questions, or other content through the Services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, publish, distribute, and otherwise use that content in connection with our business and Services.
You represent that your submission is truthful, does not violate any law or the rights of any third party, and does not contain false, misleading, defamatory, or unlawful material. We may moderate, remove, decline to publish, or edit user content in our discretion.
We do not permit fake reviews, deceptive endorsements, or reviews submitted in exchange for undisclosed compensation or consideration.
The license is non-exclusive and does not transfer ownership of your copyright. Its exercise remains subject to our Privacy Policy and any separate permission required by law. We may use licensed submissions in advertising and promotion and adapt their formatting or length without materially changing their meaning or creating a misleading endorsement.
We do not use these Terms to prohibit or penalize protected honest reviews. Moderation and editing must comply with applicable law, including restrictions on misleading review suppression. Review incentives must not depend on positive sentiment, and legally required disclosures of compensation, incentives or material connections must be made.
Third-Party Tools and Links
Our Services may include access to third-party tools, links, Content, or services. We provide those for convenience only and are not responsible for their content, availability, privacy practices, or performance.
Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using our Services, you acknowledge that you have read that policy.
Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED IN AN APPLICABLE WRITTEN WARRANTY OR GUARANTEE, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SITE, CONTENT, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the site will be uninterrupted, error-free, secure, or free from harmful components, or that Products will meet every expectation, preference, or intended commercial objective.
This section does not disclaim, modify, or limit any warranty or guarantee to the extent such disclaimer, modification, or limitation is prohibited by law, including to the extent of any applicable written consumer-product warranty.
Where governing law permits their express exclusion, the title disclaimer includes good title, rightful transfer and freedom from undisclosed liens. No disclaimer negates an express product description or written warranty, authorizes a transfer we have no right to make, or excludes an implied warranty that applicable written consumer-warranty law preserves.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDLE DIPPERS AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO OUR SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM OR USD $500.
Nothing in these Terms excludes or limits liability to the extent such liability cannot be excluded or limited under applicable law or to the extent of our express obligations under an applicable written warranty or guarantee.
Time Limit for Claims
AN ACTION AGAINST CANDLE DIPPERS FOR BREACH OF A CONTRACT FOR THE SALE OF GOODS GOVERNED BY MISSOURI REVISED STATUTES SECTION 400.2-725 MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CLAIM ACCRUES, TO THE EXTENT THAT SECTION PERMITS THE AGREED REDUCTION. This provision forms part of the original agreement only for purchases made after these Terms are presented and accepted.
Accrual, statutory tolling and any applicable savings provision are determined by law, including the rule for a warranty explicitly extending to future performance where discovery must await that performance. This is a deadline to commence proceedings after a covered claim accrues; it does not make the Limited Lifetime Warranty expire one year after purchase or shorten its coverage period.
The reduction does not apply to personal-injury, fraud, statutory or other claims for which contractual shortening is prohibited, including claims governed by Missouri Revised Statutes section 431.030 without an applicable statutory exception. Any longer non-waivable minimum period controls. It does not shorten a bank or regulator's own procedures. Report issues promptly and do not assume support correspondence extends a filing deadline.
Indemnification
You agree to indemnify, defend, and hold harmless Candle Dippers and its affiliates, licensors, service providers, officers, directors, employees, agents, and contractors from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to your breach of these Terms, your misuse of our Services or Products, your violation of law, or your infringement of any right of another person or entity.
This includes covered claims arising from your finished candles or business operations in connection with your breach, misuse, unlawful conduct, or infringement of another party’s rights. For covered third-party claims, we may control the defense with reasonably selected counsel at your expense to the extent permitted by law, after reasonable notice to you. You may participate at your own expense. You may not settle a covered claim in a manner that imposes an admission, non-monetary obligation or unreimbursed payment on us without our prior written consent.
In addition, you agree to pay our reasonable attorneys’ fees and enforcement costs incurred in establishing and remedying your material breach of these Terms, to the extent contractually recoverable and permitted by law. These obligations apply to the fullest extent permitted by law and do not authorize duplicate recovery or a fee merely for exercising a protected right.
Informal Resolution First
Most problems can be resolved faster and more fairly through direct communication. Before starting arbitration or filing a legal claim, the party asserting the dispute must send written notice describing the issue and the requested resolution. The parties will use good-faith efforts to resolve the matter informally for at least 30 days before formal proceedings begin.
Legal notices to Candle Dippers must be sent to Candle Dippers, P.O. Box 625, Belle, MO 65013, legal@candledippers.com. Routine customer service, order support, return requests, and warranty intake should be sent to support@candledippers.com.
This requirement applies except to the extent applicable law or mandatory arbitration-administrator rules prohibit it. It does not restrict a legally protected payment dispute or regulatory complaint, a warranty proceeding for which law prohibits this prerequisite, or court relief expressly permitted by the arbitration section. No contractual waiting period extends a legal filing deadline.
Binding Individual Arbitration; Class Action Waiver
Except for disputes that qualify for small claims court and except for claims by Candle Dippers seeking injunctive or equitable relief relating to intellectual property, confidential information, unauthorized access, fraud or misuse of our Services, any dispute arising out of or relating to our Services, Products or these Terms will be resolved by final and binding arbitration on an individual basis, to the extent permitted by applicable law. If governing law or mandatory administrator rules require corresponding court relief to be available to both parties, it is available to both to that extent. Claims or remedies that cannot lawfully be subjected to binding individual arbitration remain subject to the required forum and procedure.
Arbitration will be administered by the American Arbitration Association under the rules it determines applicable, including its Consumer Arbitration Rules and Mediation Procedures where required. Rules and filing information are available at adr.org. We will comply with applicable business-fee, clause-review and registry requirements. No variation in these Terms overrides mandatory law or mandatory AAA administration requirements.
Unless the parties agree otherwise, arbitration will take place in Maries County, Missouri, or by remote means if permitted by the applicable rules, subject to any location or hearing-method requirement imposed by applicable law or mandatory AAA rules.
If AAA declines to administer for a reason that law and its governing rules permit to be addressed through a substitute, the parties will confer in good faith to select another mutually acceptable administrator. If they cannot agree, either party may ask a court of competent jurisdiction to appoint an arbitrator or administrator where authorized by law. This procedure does not override court recourse or other consequences required by law or AAA rules for a business's nonpayment or noncompliance.
YOU AND CANDLE DIPPERS AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, COORDINATED OR REPRESENTATIVE ACTION, TO THE FULLEST EXTENT PERMITTED BY LAW. NO ARBITRATOR MAY CONDUCT CLASS ARBITRATION WITHOUT BOTH PARTIES' EXPRESS WRITTEN CONSENT. This does not prohibit common counsel or procedures mandatory under the administrator's rules, or waive a claim or remedy that law makes non-waivable.
TO THE FULLEST EXTENT A KNOWING AND VOLUNTARY PRE-DISPUTE WAIVER IS ENFORCEABLE, YOU AND CANDLE DIPPERS WAIVE ANY RIGHT TO A JURY TRIAL FOR A DISPUTE PERMITTED TO PROCEED IN COURT. This separate waiver is subject to legally required notice, assent and other conditions.
If any part of this arbitration section is found unenforceable as to a particular claim or remedy, that part will be severed and the rest enforced to the maximum extent permitted by law.
This version creates no new contractual arbitration opt-out. Any valid opt-out or unexpired opt-out period acquired under an earlier accepted version remains governed by that version. This revision does not retroactively change an existing transaction's agreement.
Governing Law and Venue
These Terms and any dispute arising out of or relating to them, our Services, or our Products will be governed by the laws of the State of Missouri, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions above.
For any claim permitted to proceed in court, you and Candle Dippers consent to the exclusive jurisdiction and venue of the state and federal courts serving Maries County, Missouri, except to the extent prohibited by non-waivable law.
Force Majeure
We are not liable for delays, interruptions, or failures resulting from causes beyond our reasonable control, including severe weather, fire, flood, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, governmental action, carrier delays, supply shortages, power failures, internet outages, cyberattacks, or third-party service failures.
This does not suspend a delay notice, cancellation, refund or other obligation that applicable law requires, including the obligations described in our Shipping Policy and Purchase Options Policy.
Severability; No Waiver; Entire Agreement
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and deemed modified, narrowed, or severed only to the extent necessary, and the remainder of these Terms will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.
These Terms, together with the policies incorporated by reference and any separate written agreement signed by an authorized representative of Candle Dippers, constitute the entire agreement between you and Candle Dippers with respect to the subject matter hereof.
Termination
We may suspend or terminate access to our Services, refuse service, cancel pending orders, or take other protective action if we believe you have violated these Terms, acted fraudulently, created risk or liability, or misused our Services or Products.
Accrued payment obligations, intellectual property restrictions, liability limitations, indemnification and dispute provisions survive to the extent their nature and applicable law permit. Termination does not retroactively cancel an earned refund, an existing warranty, or another right that cannot lawfully be removed. Unfulfilled orders remain subject to the applicable cancellation and refund terms.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, asset sale, reorganization, or operation by an affiliate.
Changes to These Terms
We may update these Terms prospectively from the stated effective date. For later use or transactions, revised terms apply after legally sufficient notice and assent, including continued use where governing law recognizes it. We may provide notice through the Services or electronically where sufficient; we will obtain additional consent where required for material changes to an ongoing arrangement.
An existing order and its warranty remain subject to the promises and terms validly agreed when it was placed, unless you later agree to a lawful change. Posting a new version does not itself retroactively change a transaction or resolve an existing dispute. Updates do not authorize undisclosed recurring charges.

Our store is hosted by Shopify. Information about your visits and purchases is shared with Shopify and other providers, which may be located in other countries. Shopify processes this information to operate the store and, through Shopify Network Intelligence, provide enhanced services that incorporate information from your interactions with our store, other merchants and Shopify, including personalization and advertising. Accepting these Terms does not replace separate consent required for non-essential tracking or marketing.
